Please read these Terms & Conditions ("Terms") carefully before using graffitimountain.com (the "Site") or placing an order with Graffiti Mountain, LLC ("Graffiti Mountain," "we," "us," or "our"). By accessing the Site or completing a purchase, you agree to be bound by these Terms. If you do not agree, please do not use our Site.
1. Use of the Site
You must be at least 18 years of age to make a purchase on this Site. By placing an order, you represent that you meet this requirement.
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Site. Prohibited conduct includes but is not limited to:

Reproducing, duplicating, or exploiting any portion of the Site for commercial purposes without our written consent
2. Products & Availability
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or cancel orders at our discretion. Product images are for illustrative purposes; slight variations in color or finish may occur due to screen settings or production processes.
Graffiti Mountain offers three types of products, each with distinct terms:

Drop Merchandise: In-stock items available during scheduled release windows. Limited quantities; no restocks guaranteed.

Presale Items: Products purchased before production. By purchasing a presale item, you acknowledge the estimated fulfillment timeline and agree to the presale-specific refund terms outlined in our Refund & Return Policy.

Print-on-Demand Items: Products fulfilled through Printify, produced individually per order.

Custom & Collab Orders: Merchandise produced for creators or brands per agreed specifications. Subject to separate project terms communicated at time of engagement.
3. Pricing & Payment
All prices are listed in U.S. dollars. Prices are subject to change without notice. The price charged will be the price displayed at the time you complete your order.
We accept payment via Wix Payments and PayPal. By submitting payment, you represent that you are authorized to use the payment method provided. All transactions are processed securely through our payment partners; Graffiti Mountain does not store full payment card details.
We reserve the right to cancel any order where a pricing error has occurred. In such cases, we will notify you and issue a full refund.
4. Order Confirmation & Cancellation
You will receive an order confirmation email after your purchase. This confirmation does not constitute acceptance of your order; it is an acknowledgment that we have received it. We reserve the right to cancel or refuse any order for reasons including product unavailability, suspected fraud, or pricing errors.
Once an order has been submitted, cancellations may not be possible, particularly for presale and custom orders. Please contact us immediately at the email below if you need to request a cancellation and we will do our best to accommodate.
5. Shipping
Shipping terms, estimated delivery windows, and carrier information are outlined in our Shipping Policy, which is incorporated into these Terms by reference. Graffiti Mountain is not responsible for delays caused by carriers, customs processing, or circumstances outside our control.
6. Returns & Refunds
Return and refund eligibility varies by product type and is governed by our Refund & Return Policy, which is incorporated into these Terms by reference. Please review that policy before completing your purchase.
7. Intellectual Property
All content on the Site -- including but not limited to graphics, logos, product designs, photography, copy, and the Graffiti Mountain name and brand -- is the property of Graffiti Mountain, LLC or its licensed partners and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission. Purchasing a product does not transfer any intellectual property rights to you beyond the right to use the physical item for personal purposes.
8. User-Submitted Content
If you submit any content to us -- including collab inquiries, project briefs, or creative materials -- you represent that you own or have the rights to that content and that it does not infringe any third party's intellectual property or other rights. You grant Graffiti Mountain a non-exclusive, royalty-free license to use submitted content solely for the purpose of responding to your inquiry or fulfilling your order.
9. Custom & Collab Orders
Custom merchandise and collab projects are subject to a separate project agreement or order confirmation outlining scope, deliverables, timelines, and payment terms. These Terms apply to all collab engagements except where the project agreement explicitly supersedes them. Custom orders are final sale; see our Refund & Return Policy for quality claim terms.
10. Disclaimer of Warranties
The Site and its contents are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of Liability
To the fullest extent permitted by law, Graffiti Mountain, LLC, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of products, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid for the order giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Graffiti Mountain, LLC and its owners from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Site, your violation of these Terms, or your infringement of any third-party rights.
13. Third-Party Links & Services
The Site may contain links to third-party websites or integrate third-party services (such as Printify and payment processors). These are provided for convenience only. Graffiti Mountain does not endorse and is not responsible for the content, privacy practices, or terms of any third-party site or service.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Connecticut, and you consent to personal jurisdiction in those courts.
We encourage you to contact us directly at the email below before initiating any formal dispute. We will make a good faith effort to resolve issues informally.
15. Changes to These Terms
We reserve the right to update these Terms at any time. The revised Terms will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
